Why Ilhabela needs extra care
Ilhabela State Park covers 27,025 hectares, about 84% of the municipality. What is left is limited, and a plot usually sits under several layers of rules at once: the town master plan (Law 421/2006), the state coastal zoning (Decree 62,913/2017) and federal environmental law. The property registry is not on the island either: it is in São Sebastião.
1. Who owns it: the matrícula
Request an up-to-date certificate of the matrícula (title record) from the São Sebastião property registry, which covers Ilhabela. Check the owner, area, debts and restrictions. If a listing mentions direitos possessórios, the seller is offering possession, not registered ownership. That can sometimes be regularized, but it changes the risk and the timeline, so take it to an attorney before negotiating.
2. What the town allows: the zoning certificate
The Certidão de Diretrizes de Uso e Ocupação do Solo is requested from the town's housing and land department, with ID, CPF and the property tax statement, registration number or address with a front photo. The stated deadline is 15 days. Look for four things:
- Zone: the plot's classification.
- Taxa de ocupação (T.O.): how much of the land the building may cover.
- Coeficiente de aproveitamento (C.A.): how much you may build across all floors.
- Minimum lot and setbacks: whether the plot meets the rule and how far the house must sit from the boundaries.
Ask a question few people ask: do these figures apply to the whole plot, or only to the area outside the APP? The answer can decide whether a house fits. In one real study, a plot of about 1,170 m² had only about 330 m² outside the APP. At a T.O. of 15%, the footprint would be about 176 m² on the whole plot, but about 50 m² on the free area. The town gives that answer, through an architect or engineer.
3. How much is protected area (APP)
Article 4 of the Forest Code defines Áreas de Preservação Permanente. Three cases are common here:
- Rivers and streams: a 30 m strip on each bank for watercourses under 10 m wide, and wider strips for larger ones. In consolidated urban areas, municipal law may set a different strip, so confirm the rule in force at that spot.
- Slopes: stretches steeper than 45 degrees.
- Restingas that hold dunes or stabilize mangroves.
A stream at the back of a plot can take up much of it. Check the survey, not only the site.
4. What the vegetation requires
Removing native vegetation may need CETESB authorization, usually with a vegetation report and compensation. Also ask whether the plot is in the park's buffer zone, since the master plan refers that zone's rules to the park's management plan. Put this cost and time in your budget before agreeing a price.
5. Federal coastal land (terreno de marinha)
Terrenos de marinha belong to the federal government, even on an island that is a municipal seat. Occupiers pay an annual fee, and a transfer usually involves a 5% laudêmio on the land value plus a transfer authorization certificate (CAT). Ask the seller for the RIP number or check with the federal property department (SPU). SPU registration does not replace a building permit or environmental license. Near the sea, always confirm, even if the listing does not mention it.
6. What it really measures
Without a survey, everything above is an estimate. A topographic survey shows boundaries, slope, streams and free area. With it, every meter counts. In the same study, the free strip was narrow, and each meter of front garden shrank the house:
| Garden setback | House that fit | Per floor |
|---|---|---|
| 2 m | 15 × 6.5 m | about 97 m² |
| 3 m | 12 × 6 m | 72 m² |
| 4 m | 10 × 6 m | 60 m² |
A fit study, without legal setbacks applied and without an approved project. It shows the method and does not apply to another plot.
A picture is not a project. A beautiful image made before measuring can show a house that does not fit. Measure first, then draw.
Also check
- Legal access to the plot, water, power and a sewage solution.
- Condominium or subdivision rules, where they exist.
- The seller's certificates, reviewed by an attorney.
- Purchase costs: ITBI transfer tax, deed and registration. Ask the notary and the town for current amounts.
- Foreign buyers: a CPF comes first, and the rules for rural property and terreno de marinha need attention. Speak to an attorney early.

Frequently asked questions
Can I build on the whole plot I buy?
Not always. Usable area depends on protected areas (APP), the occupancy rate, the floor-area ratio, the minimum lot and setbacks. Check the zoning certificate and a survey before paying a deposit.
Where are Ilhabela properties registered?
At the São Sebastião property registry, which serves both municipalities.
How long does the zoning certificate take?
The Ilhabela town hall states 15 days. The request goes to its housing and land department, with ID, CPF and the property details.
How wide is the protected strip along a stream?
Under the Forest Code, 30 m on each bank for watercourses under 10 m wide. In consolidated urban areas, municipal law may set a different strip, so confirm the rule at that spot.
How do I know if a plot is terreno de marinha?
Ask the seller for the RIP number or check with the federal property department (SPU). Near the sea, always confirm.
Are direitos possessórios the same as ownership?
No. The seller is offering possession, not registered ownership. That changes the risk and the timeline, so take it to an attorney before negotiating.
Can a foreigner buy land in Ilhabela?
Generally yes for urban property, with a CPF. Rural property and terreno de marinha have their own rules, so speak to an attorney early.
